FREMONT, CALIFORNIA— A Fremont-based company is under investigation after being accused of employing Chinese workers illegally and discriminating against non-Chinese employees.
The allegations, which have raised concerns about labor practices and discrimination in the area, were brought to light by a whistleblower from within the company.
The Allegations: Illegal Employment and Discrimination
According to the complaint, the company allegedly employed Chinese workers on work visas without proper documentation, bypassing U.S. labor laws. Furthermore, the company is accused of discriminating against non-Chinese employees by giving preferential treatment to Chinese workers in hiring, promotions, and job assignments.
Former employees have reported that non-Chinese workers were often passed over for promotions, while Chinese workers were fast-tracked into high-paying roles.
The company reportedly employed a significant number of Chinese nationals in technical positions, while local employees were relegated to lower-paying or less prestigious roles.
Federal Investigation: Labor and Immigration Violations
The U.S. Department of Labor and U.S. Immigration and Customs Enforcement (ICE) have launched a joint investigation into the company’s practices.
Authorities are examining whether the company violated immigration laws by employing foreign workers without the correct work visas and if they discriminated against non-Chinese employees in violation of Title VII of the Civil Rights Act.
“We take these allegations very seriously and will fully investigate to ensure compliance with U.S. labor and immigration laws,” said ICE spokesperson Richard A. Thompson.
Employees Speak Out: Discriminatory Practices
Several former employees have come forward with stories of discriminatory treatment. One former worker, John Rodriguez, said that non-Chinese employees were given fewer opportunities for promotion and better job assignments. “It was clear that being Chinese gave you an advantage,” Rodriguez said.
Another ex-employee, Sarah Lee, described how non-Chinese workers were assigned to lower-level positions despite having more experience than their Chinese counterparts. “It created a toxic environment,” Lee added, “where it felt like you were stuck, regardless of your abilities.”
Company’s Response: Denial of Allegations
The company, in a public statement, denied the allegations, calling them “false and baseless.” The spokesperson emphasized that the company follows all legal hiring procedures and ensures equal opportunities for all employees.
“We are committed to diversity and equality in the workplace, and we have a zero-tolerance policy for discrimination,” the statement read.
